The Commission has prepared its third annual compliance assessment for the ACT GAS Scheme. As the regulator of the Scheme, the Commission must report to the Minister of the Environment, Water and Climate Change on the extent to which Scheme participants have complied with the greenhouse gas benchmark determined under the Electricity (Greenhouse Gas Abatement) Act 2004. In addition, the report must indicate the name of each participant, and the total number of abatement certificates surrendered for each kind of certificate, and any functions delegated by the regulator. Section 16 of the ACT's Electricity (Greenhouse Gas Emissions) Act 2004 specifies that a penalty is the amount prescribed by regulation adjusted in accordance with the regulations and may be adjusted in accordance with movements in the All Groups Consumer Price Index (CPI) for Canberra issued by the Australian Statistician. A penalty series for the period 2004-05 to 2007-08 is set out in the attached paper. A penalty of $11.50 applies for the 2007 compliance year.
