ACT Electricity Feed-in Scheme Summary Report- September 2013 Quarter

The Electricity Feed-in Scheme for feed-in from renewable energy generators to the electricity network is established under the Electricity Feed-in (Renewable Energy Premium) Act 2008 (ACT).  The Scheme commenced on 1 March 2009.

The Electricity Feed-in code is an industry code determined by the Commission under Part 4 of the Utilities Act 2000(ACT).  The Code sets out practices and standards for the operation of the Scheme.  Under the Code, licensed electricity suppliers and ActewAGL Distribution, the ACT’s only licensed electricity distributor, are required to report quarterly to the Commission on a number of key indicators.

Electricity Feed-in Premium Rate Determination

In February 2011, the Minister for Energy, Simon Corbell MLA, asked the Commission to provide him with advice to assist with the determination of the premium rate to be paid from 1 July 2011 for electricity supplied by compliant renewable energy generators to the distribution network under the provisions of the Electricity Feed-in (Renewable Energy Premium) Act 2008.  The Minister requested additional advice on 11 March 2011.

The Commission transmitted its advice on 16 March 2011.  The Final Report is available below:

Variation of Electricity Feed-in Code

The Commission has determined a number of minor variations to the Electricity Feed-in Code, an industry code made under the ACT Utilities Act 2000 that sets out practices and standards for the operation of the ACT Electricity Feed-in Scheme.

The principal variations are the updating of Schedule 2 of the Electricity Feed-in Code to ensure consistency with the present version of the Consumer Protection Code and removal of spent provisions relating to the commencement of utility reporting arrangements.

There is no change to any substantive provisions of the Electricity Feed-in Code or to utilities’ obligations under the Code.

New Role for Commission Legislated Through Electricity Feed-in Act

The Electricity Feed-in (Renewable Energy Premium) Act 2008 was amended with effect from 1 March 2009.  The amendments include a new provision in relation to the premium rate requiring the Minister to seek the advice of the Commission to assist in its determination.


Electricity Feed-in Industry Code

The Commission has determined an industry code, the Electricity Feed-in Code, under section 59 of the Utilities Act 2000.

The code sets out practices and standards for the operation of the scheme for feed-in from renewable energy generators to the electricity network established under the Electricity Feed-in (Renewable Energy Premium) Act 2008.  Electricity distributors and suppliers are required to comply with the code.

Matters covered include information that must be provided by electricity suppliers to occupiers of premises, dispute resolution, reporting to the Commission, and the applicability of provisions of the Consumer Protection Code to the feed-in scheme.

The Commission released a draft code on 23 January 2009 and invited submissions. Feed-in Tariff Discussion Paper - Commission Comments
