GreenPower Scheme


On 25 March 2009, the Commission varied all electricity supply licences granted under the Utilities Act 2000 (the Utilities Act).  The variations give effect to the ACT GreenPower Scheme and take account of requirements imposed under the Electricity Feed-in Scheme in relation to electricity supply utilities.  An open letter from the Commission to stakeholders regarding the variations is available below.

Submissions

Background

On 22 January 2008, the Minister for Environment, Climate Change and Water, Mr Jon Stanhope MLA, directed the Commission to give effect to the GreenPower Scheme through suitable variations to the licence conditions of electricity retailers issued under the Utilites Act 2000no later than 1 January 2009.  The Commission prepared an Information Paper setting out the elements of the Scheme accompanied by a document with proposed variations to the standard utilities electricity supply licence provisions.  The Commission invited views on the proposed variations to the licence conditions by 24 October 2008.  The Information Paper, Draft Licence Conditions and submissions received are available below.

On 8 December 2008, the Minister for the Environment, Climate Change and Water, Mr Simon Corbell MLA, wrote to the Commission advising that he had agreed to move the date of commencement of the Scheme to 1 April 2009 to enable further examination of the proposed licence conditions so there will no longer be any uncertainty as to its intention or its implementation.  On 27 February 2009, the Minister revoked the earlier direction to the Commission and made a new direction which altered some elements of the Scheme.  The direction and accompanying explanatory statement are available through the ACT Government Legislation Register at:
